Terms of Service

Effective Date: February 27, 2026

These Terms of Service ("Terms") govern your use of services provided by Hawthorn Consulting, LLC ("Hawthorn," "we," "us," or "our"). By purchasing, accessing, or using any of our services, you agree to be bound by these Terms.

1. Services

Hawthorn provides managed IT services including, but not limited to: web hosting, email hosting, business phone (VoIP/PBX), desktop support, network monitoring, DNS management, PC backups, website design and management, and broadband consulting.

2. Acceptable Use Policy

You agree to use our services only for lawful purposes. The following activities are strictly prohibited:

  • Spam & Unsolicited Communications: Sending bulk unsolicited email, SMS, or other messages.
  • Malicious Activity: Distributing malware, conducting DoS attacks, unauthorized access attempts.
  • Illegal Content: Hosting or distributing any content illegal under federal or state law.
  • Network Abuse: Port scanning, packet sniffing, IP spoofing, or service disruption.
  • Fraud: Phishing, identity theft, or financial fraud via our services.
  • Copyright Infringement: Hosting copyrighted material without authorization.
  • Resource Abuse: Cryptocurrency mining or excessive resource consumption.

3. Termination & Suspension

Hawthorn reserves the right to suspend or terminate your services immediately, without prior notice, if we determine you have violated any provision of the Acceptable Use Policy.

In such cases:

  • We may suspend access pending investigation.
  • We may permanently terminate your account if violation is confirmed.
  • No refund will be issued for the current billing period.
  • We may cooperate with law enforcement if criminal activity is suspected.

4. Termination by Customer

You may cancel at any time by contacting customerservice@hawthornconsulting.net. Services remain active through the end of the current billing period. No refunds for partial periods.

5. Payment

  • Services are billed monthly unless otherwise agreed in writing.
  • Payment is due upon receipt of invoice.
  • Accounts past due by more than 30 days may be suspended.
  • We reserve the right to modify pricing with 30 days' written notice.

6. Data & Privacy

  • We do not sell, share, or distribute your personal data to third parties.
  • We retain backups as part of service, but you are responsible for your own backups.
  • Upon termination, data is retained 30 days for retrieval, then may be deleted.
  • We access account data only to provide services, troubleshoot, or comply with legal obligations.

7. Service Availability

We strive for high availability but do not guarantee 100% uptime. We are not liable for downtime caused by circumstances beyond our control, including natural disasters, power outages, upstream provider failures, or cyberattacks.

8. Limitation of Liability

Total liability shall not exceed the amount paid by you in the three months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

9. Indemnification

You agree to indemnify and hold harmless Hawthorn from any claims arising from your use of our services or violation of these Terms.

10. Modifications

We may update these Terms at any time. Material changes will be communicated via email or posted on our website.

11. Governing Law

These Terms are governed by the laws of the State of Oklahoma. Disputes shall be resolved in the courts of Payne County, Oklahoma.
